Sample Cemetery Listing Agreement

Dear Customer: 

Buy and Sell Cemetery Plots llc specializes in bringing cemetery plot buyers and sellers together through our unique marketing program.  We are pleased to have you as a client!

Enclosed you will find a copy of your cemetery plot listing.  Review it carefully to insure it is correct in every aspect, especially as it pertains to the description of the plot.  Contact us immediately with corrections.  Although we encourage buyers and sellers to investigate the cemeteries rules and regulations, plot burial capacity, plot location, space number and or whatever, they do not always do so.  If the unit does not match the description in the ad, a disappointed buyer may look to you to compensate him for an erroneous description.

We are a “for-sale-or-rent-by-owner” advertiser.  We do not charge commissions nor do we require appraisals.

When we have a verified offer, we will notify you.  You can accept, decline, or make a counter offer.

When we have written confirmation of the terms of the transaction, our client services department takes over.  Typically closing occurs within six to eight weeks after we have received a performance deposit from the buyer and have a legible copy of the seller’s recorded deed or ownership forms.

When the buyer’s funds are in our escrow account and we have a properly executed agreement, other transfer documents, the proceeds are distributed and the transfer documents are forwarded to the appropriate officials for recording or other registration.

Buy and Sell Cemetery Plots llc will advertise your cemetery plot until sold, or for up to twelve months, whichever occurs first.  You may renew at no charge for another twelve months by giving us written notice thirty days before the first twelve months end. Buy and Sell Cemetery Plots llc, will refund 50% of the advertising fee if your cemetery plot is sold in any other way within 50% of the original sale price upon proof of a bona fide sale occurring during the original listing period.  Otherwise, the listing fee is non-refundable. There is no guarantee that the cemetery property will sell at any price.

Some transfers may incur additional costs due too particulars of the local market due to this fact There may be additional fees charged by the cemetery, its management company, city, and or state that it is located in. We will contact these entities and request a copy of any additional costs you may incur, we will then notify of these terms. If you decide not to sell your cemetery plot at that time a service fee of $49.95 will be charged to cover the costs of paperwork and our research services. A seller must be able to produce a legible copy of a contract or purchase record showing ownership in there name. Otherwise, we will attempt to obtain a copy for a fee of $100.00 plus our out of pocket costs (usually less than $25.00). We do not absorb these fees.

Any disputes between Buy and Sell Cemetery Plots llc, and owner(s) shall be resolved by proceedings occurring in Pinellas County, Florida.
